The MP proposes establishing minimum fine limits and not applying exemption from liability for large sums.
This was stated by MP Vugar Bayramov at today's plenary session of the Milli Majlis.
He stated that, according to the proposed changes, a shift from a fixed fine mechanism to a percentage-based system is envisioned for cases of misuse of state funds. In such instances, a fine equivalent to 100 percent of the funds, along with deprivation of liberty, is also envisioned.
The MP noted that it is important to establish specific minimum fine amounts for this article.
V. Bayramov added that, according to other proposed changes, a person who commits this act for the first time may be exempted from criminal liability if they fully compensate for the damage caused. He believes that this approach should only apply to cases involving small amounts.
According to the MP, in Azerbaijan, a significant amount of damage is considered to be 50–250 thousand Manat, and a large amount is above 250 thousand Manat. For this reason, applying such concessions to cases of diverting large sums of funds from their intended purpose is not appropriate. (modern)
