Penalties for evading military service in Azerbaijan to be reviewed

Penalties for evading military service, as stipulated in the Criminal Code, will be reviewed.

According to information from the editorial office, citing Trend, the Constitutional Court has issued relevant recommendations to the National Assembly regarding this matter.

According to the Criminal Code, evading the next military call-up or mobilization call-up without legal grounds to avoid military service is punishable by deprivation of liberty for up to two years.

The same acts, when committed during wartime, are punishable by deprivation of liberty for a period of three to six years.

Here, “evading call-up” refers to citizens failing to appear for medical examination (medical certification), fixed-term active military service, training camps, and military service under mobilization, without valid reasons.

However, according to the new decision, the Constitutional Court has recommended to the National Assembly that the criminal elements of the aforementioned article of the Criminal Code be improved towards clear and unambiguous definition.
