Amendment to the Law! Age Limit May Be Increased

It is proposed that the age limits for being in the reserve for warrant officers and midshipmen be determined on a separate line, with the age limit for first-class reserve warrant officers and midshipmen being 35 years, for second-class reserve warrant officers and midshipmen being 45 years, and for third-class reserve warrant officers and midshipmen being 55 years.

Valyuta.az reports that amendments to the "Regulations on Military Service" and the "Law on Military Duty and Military Service" are proposed in this regard.

The draft law was discussed at today's online meeting of the Milli Majlis Committee on Defense, Security, and Anti-Corruption.

It was noted that the presented draft law was prepared with the aim of improving the rules for the actual military service of warrant officers and midshipmen, as well as several other norms.

Thus, in accordance with paragraph "q" of Article 12 and Article 38.1.4 of the currently effective "Regulations on Military Service" and the "Law of the Republic of Azerbaijan on Military Duty and Military Service," respectively, the duration of actual military service in peacetime for all warrant officers and midshipmen has been set at 5 years.

Considering that military personnel who have received education in specialized secondary vocational education institutions that train military personnel, as well as in similar secondary vocational education institutions in foreign countries, are specialized professional cadres, and with the aim of utilizing their knowledge and skills for the defense of our country for a longer period, the project proposes to set the duration of actual military service in peacetime at 10 years for warrant officers and midshipmen who have graduated from specialized secondary vocational education institutions that train military personnel, as well as similar secondary vocational education institutions in foreign countries.

In paragraph "v" of Article 26 and Article 36.1.3 of the aforementioned laws, respectively, the list of persons eligible for actual military service as warrant officers and midshipmen includes military conscripts up to 40 years of age (excluding officers). The project proposes to specify the phrase "military conscripts up to 40 years of age" by replacing it with "reserve warrant officers and midshipmen who have not reached the maximum age limit for military service, reserve soldiers, sailors, and sergeants up to 40 years of age."

Furthermore, in the tables reflected in Articles 172 and 44.1 of the aforementioned laws, respectively, the maximum age limits for being in the reserve for soldiers, sailors, sergeants, warrant officers, and midshipmen were determined on the same line. It is proposed to amend the tables reflected in these articles by determining the age limits for being in the reserve for warrant officers and midshipmen on a separate line, with the age limit for first-class reserve warrant officers and midshipmen being 35 years, for second-class reserve warrant officers and midshipmen being 45 years, and for third-class reserve warrant officers and midshipmen being 55 years.

It should be noted that, according to the current law, the age limit for third-class reserve warrant officers and midshipmen was 50.
