The bill on amendments to the Labor Code and the Law "On Narcological Service and Control" has been approved in the third reading in Parliament.
This issue was included in the agenda of the Parliament's meeting held on April 27.
It was noted that sub-paragraph 8.2.2 of the "State Program for Combating Illicit Trafficking of Narcotic Drugs, Psychotropic Substances and their Precursors, and Drug Addiction for 2025–2030," approved by the Head of State's Decree dated September 17, 2025, envisages improving the regulatory legal framework to increase employer responsibility for preventing the employment of individuals with drug addiction in professions and positions with activity restrictions for narcological patients. A bill has been prepared to amend the Labor Code and the Law "On Narcological Service and Control" within the framework of implementing the aforementioned sub-paragraph.
The project reflects the regulation of issues such as the employee submitting a medical examination (medical check-up) opinion issued by a state narcological medical institution when being admitted to professions and positions with activity restrictions for narcological patients, and undergoing relevant periodic or extraordinary mandatory medical examinations at the employer's expense if reasonable doubts arise during the employee's performance of their labor functions.
Furthermore, according to the amendment, if it is discovered that an employment contract has been concluded for the employment of a person with a narcological illness in the professions and positions mentioned in Article 74 of the Labor Code, or if a person is determined to have a narcological illness during a medical examination during the period of employment relations, the termination of the employee's employment contract is envisaged as a ground independent of the parties' will.
