The State Service for Antimonopoly and Consumer Market Control under the President conducted a preliminary investigation into “Baku Electronics” and “ABC Telecom” LLCs, which are among the main participants operating in the electronics and home appliances sales market.
According to information from the Agency, the investigation revealed that “Baku Electronics” used false and misleading information in the presentation of “YOSHİRO” branded televisions, and “ABC Telecom” used false and misleading information in the presentation of “HOFFMANN” branded oil-filled electric heaters, creating a false impression among consumers.
It was stated that providing misleading information to consumers about the origin, manufacturing method, and technology of the products in question, as well as presenting incorrect indicators about their important characteristics, was assessed as a sign of unfair competition. At the same time, false information was also found in the advertisements for “YOSHİRO” branded televisions.
Regarding the mentioned facts, the Agency initiated a case against both economic entities on the grounds of violations of competition legislation. Currently, the process of reviewing these cases is ongoing. Additional information regarding the results will be provided.
It was stated that, according to the requirements of the Competition Code, the use of any information that may mislead or deceive a customer about the origin, manufacturing method and technology, suitability for use, quality, weight, price, or other properties of a product, as well as about the economic entity or the nature of its entrepreneurial activity; the use of untrue indicators about the consumer properties and other important characteristics of a product, including distinctive signs, brands, or marks, and the placement of advertisements related thereto, are considered actions aimed at misleading or deceiving customers. Furthermore, allowing unfair competition by using unfair, inaccurate, or hidden advertising is considered illegal actions leading to unfair competition, and these actions are prohibited.
