Transparency and full neutrality are ensured by the Supreme Court in the recognition of foreign decisions

Positive advancements are observed in the Supreme Court of the Republic of Azerbaijan regarding the recognition of foreign court decisions.

This was stated by lawyer Farid Nabili.

He shared some of his observations regarding the recognition of foreign court decisions in Azerbaijan over the past two years.

The lawyer said that more transparent and improved legal procedures and sessions are held in the Supreme Court: "Even in cases involving state enterprises, the increase in neutrality and fairness is a very important advancement. For example, in one of our recognition cases, a decision amounting to 20 million AZN against a state company was recognized by the Supreme Court of Azerbaijan."

F. Nabili also shared his suggestions and recommendations on the matter:

"The concept of official suspension of court sessions is not applied, which can lead to repeated and long-term postponements of sessions without an official suspension decision. The possibility of a revocation order against the likelihood of certain facts changing during the post-recognition enforcement process should be considered as a potential protective measure. Therefore, excessive judicial caution regarding future changes could undermine the concept of 'recognition'. The merits of the case and related events occurring abroad should not be extensively re-examined."
