President Ilham Aliyev has signed a decree amending presidential decrees dated February 15, 2016, No. 795 on the application of the Law of the Republic of Azerbaijan No. 96-VQ of December 29, 2015, on the Code of Administrative Offenses of the Republic of Azerbaijan, and dated February 23, 2017, No. 1256 on the approval of the "List of Officials Authorized to Review Cases of Administrative Offenses."
The editorial presents the text of the decree:
1. The following amendments shall be made to Article 5 of the Decree of the President of the Republic of Azerbaijan dated February 15, 2016, No. 795 on the application of the Law of the Republic of Azerbaijan No. 96-VQ of December 29, 2015, on the Code of Administrative Offenses of the Republic of Azerbaijan (Collection of Laws of the Republic of Azerbaijan, 2016, No. 2 (Book II), Article 259 (Volume I); 2024, No. 2, Articles 151, 157, No. 7, Articles 806, 812, 814, 815, No. 8, Articles 937, 948, No. 12 (Book I), Article 1294, (Book II), Articles 1359, 1378, 1384; 2025, No. 2, Article 127, No. 3, Article 231, No. 4 (Book I), Articles 325, 338, No. 5, Article 463, No. 6, Articles 541, 561, No. 7, Article 649, No. 8, Articles 746, 754, No. 9, Article 820, No. 11, Article 1018; Decrees of the President of the Republic of Azerbaijan dated January 26, 2026, No. 588 and January 28, 2026, No. 593):
1.1. In item 5.48, the words "(to municipal bodies)" shall be replaced with the words ", to municipal bodies";
1.2. Item 5.50 shall be presented in the following wording:
"5.50. Cases of administrative offenses provided for in Article 432.4 of the said Code shall be reviewed by the Ministry of Justice of the Republic of Azerbaijan in relation to individuals, as well as municipalities, municipal bodies, and other non-commercial organizations, except for religious organizations; by the Central Bank of the Republic of Azerbaijan in relation to banks and other payment service providers; and by the Ministry of Economy of the Republic of Azerbaijan in relation to other commercial legal entities and public legal entities;";
1.3. Item 5.50-2 of the following content shall be added:
"5.50-2. Cases of administrative offenses provided for in Article 432-1.3 of the said Code shall be reviewed by the Ministry of Justice of the Republic of Azerbaijan in relation to non-governmental organizations; and by the Central Bank of the Republic of Azerbaijan in relation to banks and other payment service providers;";
1.4. In item 5.68, after the word "Code," the words "Articles 432-1.1, 432-1.2, and" shall be added.
2. The following amendments shall be made to the "List of Officials Authorized to Review Cases of Administrative Offenses" approved by the Decree of the President of the Republic of Azerbaijan dated February 23, 2017, No. 1256 (Collection of Laws of the Republic of Azerbaijan, 2017, No. 2, Article 200 (Volume I); 2024, No. 2, Article 157, No. 6 (Book I), Article 649, No. 7, Articles 806, 812, 814, No. 8, Article 948, No. 12 (Book I), Articles 1294, 1295, (Book II), Article 1378; 2025, No. 2, Article 127, No. 4 (Book I), Article 325, No. 5, Article 463, No. 8, Article 746, No. 9, Article 820; Decree of the President of the Republic of Azerbaijan dated January 28, 2026, No. 593):
2.1. In item 3.1, after the numbers "432.1," the words "and 432.4" shall be added, and in the same item, the words "(to municipal bodies)" shall be replaced with the words ", to municipal bodies," and the words "432.4 (to non-governmental organizations, branches and representative offices of non-governmental organizations of foreign states" shall be replaced with the words "432-1.1, 432-1.2, 432-1.3 (to non-governmental organizations";
2.2. In item 15.0, after the numbers "432.4," the words "and 432-1.3" shall be added, and after the word "banks," the words "and other payment service providers" shall be added.
